Terms & Conditions
§1 Scope of Services / Project Definition
The scope of services is defined in the respective offer. Any services not explicitly listed are not included in the agreement and will be charged separately.
§2 Payment Terms
Invoices are payable within 14 days of issuance without deduction unless otherwise agreed in writing. The contractor reserves the right to request a deposit of up to 40% before the start of production.
Unless otherwise specified, accommodation and meals shall be provided by the client for the contractor. Expenses incurred outside the service period and beyond the provided services shall be borne by the contractor themselves.
§3 Cancellation Compensation
In case of cancellation by the client, the following cancellation fees apply unless the cancellation is due to circumstances attributable to the contractor:
up to 14 days before the scheduled date: 50% of the agreed fee
up to 7 days before the scheduled date: 70% of the agreed fee
less than 48 hours before the scheduled date: 100% of the agreed fee
The client reserves the right to prove that no or significantly lower damages have been incurred.
If the project cannot be executed due to force majeure (including but not limited to extreme weather conditions, official restrictions, or other unforeseeable events beyond the control of either party), the contractor shall be entitled to a reasonable cancellation fee amounting to 40% of the agreed remuneration.
§4 Copyright and Usage Rights
The contractor retains full copyright ownership of all created audiovisual material.
Upon delivery of the final content and full payment of the agreed fee, the client is granted a simple, non-exclusive, non-transferable and non-sublicensable right of use.
This right of use is granted for the purposes defined in the respective offer or project agreement and allows the client to use the delivered content freely within this agreed scope.
Any use beyond this scope, including but not limited to editing, redistribution, sublicensing, or use for other purposes or third parties, requires prior written consent from the contractor.
§5 Client Cooperation Obligations
The client agrees to provide all necessary information, materials, and approvals in a timely manner. Delays caused by the client may result in additional costs and deadline extensions.
§6 Delivery and Deadlines
Delivery dates are non-binding unless explicitly agreed otherwise. Delays due to unforeseen circumstances or client delays do not constitute grounds for compensation.
§7 Credit / Attribution
Where the content is published publicly (including but not limited to social media platforms such as Instagram, YouTube, or similar), the client agrees to provide appropriate credit to the contractor, for example by tagging or mentioning the contractor’s name or profile, where technically and practically possible.
§8 Archiving of Material
The contractor is not obligated to store raw or final files beyond 6 months after delivery unless otherwise agreed in writing.
§9 Right to Use for Portfolio / Self-Promotion
The contractor reserves the right to use the produced material for self-promotion, including portfolio, website, and social media, unless explicitly agreed otherwise in writing.
§10 Changes / Revision Requests
Included are up to X revision rounds. Additional changes will be charged based on hourly rates.
§11 Artistic Freedom
The client is responsible for the content-related and creative direction of the project. However, the contractor retains creative discretion regarding the execution of services (including but not limited to camera choice, lenses, lighting, framing, and editing style).
§12 Location Access, Fees, Permits
If the client chooses a location that requires fees for access and/or permission to photograph, the client shall be responsible for all costs associated with shooting at that location, including admission fees and parking charges. The client is also responsible for arranging access to the production site and obtaining any permits required for this purpose.
§13 Priority of Agreement
In case of any conflicting provisions between these Terms and Conditions and the individual offer or project agreement, the terms of the offer or project agreement shall prevail.
§14 Breach of Contract
In the event of a breach of this agreement by the contractor, the client shall be entitled to terminate the agreement and withhold any future payments due to the contractor.
§15 Severability Clause
If any provision of this agreement is or becomes invalid, the validity of the remaining provisions shall not be affected. The parties undertake to replace the invalid provision with a valid provision that comes as close as possible to the economic intent of the invalid one.
